Buying Property in Cyprus from the USA in 2027: Permit, Sending Dollars, FATCA, FBAR and US Tax on a Sale

9 min read

An American can buy property in Cyprus, but not on the terms of an EU buyer: a US citizen is a non-EU purchaser and needs Council of Ministers permission, which the buyer's lawyer files after the contract is signed. The money side is in euros, so a €250,000 new-build at 19% VAT comes to about €300,975 with fees, or roughly $346,000 at an illustrative $1.15 to the euro, and a 5% move in the rate shifts that by about $17,000. The home itself does not go on Form 8938 when you own it in your own name, but any Cyprus bank account counts towards the FBAR at $10,000, and a sale is taxed twice: Cyprus charges 20% on the gain and the IRS taxes the dollar gain, with a foreign tax credit between them. This guide takes the purchase in the order it happens, from the permit to the sale, with the Cyprus rules from our own guides and the US rules from the IRS (read on 6 November 2026).

Buying property in Cyprus as an American: the permit and the order of steps

EU citizens buy in Cyprus on the same terms as Cypriots. A US citizen does not: the Acquisition of Immovable Property (Aliens) Law, Cap. 109, requires non-EU buyers to obtain permission from the Council of Ministers. Your lawyer prepares the application on Form COMM 145 once the contract is signed, there is no government fee, and the authorities look for a clean criminal record, proof that you can support yourself and proof that the purchase money comes from abroad. The permit can take from a few weeks to several months, which is why it is filed at once. Published guidance gives the permit as covering one house or apartment per family, or a plot of up to 4,014 m² for building a home. In 2026 a bill in parliament proposed new limits on what foreigners may acquire, and we could not confirm its outcome, so ask your lawyer what applies on the day you buy.

The full sequence, with the costs of each step, is in how to buy property in Cyprus as a foreigner. On a new-build, lodging the contract is the step that protects you most, as our guide to off-plan deposits explains.

Sending dollars to Cyprus: what the contract costs in your currency

The price, VAT and fees are all in euros, and you pay them by wire from your US account. Two things are asked of the money. The permit application wants the purchase funds to come from abroad, and the lawyer and the Cypriot bank will ask where the money came from, usually with bank statements and the sale or savings that produced it; transferring money to Cyprus lists the documents. Send from an account in your own name, since a transfer from a relative or a company invites questions.

The Cypriot side will also treat you as a US person. The United States and Cyprus signed a Model 1 intergovernmental agreement on FATCA on 2 December 2014: Cypriot financial institutions identify account holders who are US citizens or residents and report them to the Cyprus tax authority, which passes the information to the IRS. In practice a Cyprus bank asks you to state your US status and give your US taxpayer identification number when you open an account, as the self-certification in our bank account guide shows.

A worked example for a new-build bought as a second home, with the dollar figure at an illustrative rate of $1.15 to the euro (chosen only for the arithmetic, so check the live rate). VAT is 19% because the home is not your main residence; the legal fee is planned at 1% plus VAT, and the Land Registry charges are put at €500.

ItemEurosUS dollars at $1.15
Price of the apartment€250,000$287,500
VAT at 19%€47,500$54,625
Legal fee, 1% plus 19% VAT on the fee€2,975$3,421
Land Registry charges (planning figure)€500$575
Total cash needed€300,975$346,121

A new-build is not paid on one day. Off-plan instalments fall due as construction proceeds, so each is converted at the rate of its own day. If the euro rises 5% against the dollar between the first and the last instalment, the whole total above costs about $17,300 more (5% of $346,121). Ask your bank or a regulated currency provider whether it can fix a rate in advance for the instalments you already know about. A resale pays transfer fees instead of VAT, which the cost of buying property in Cyprus works through, and the VAT guide explains when 5% applies.

Financing a Cyprus purchase from the US

Most Cypriot banks lend to residents. For a non-EU buyer who lives abroad the market is a short list of lenders, with loan-to-value of about 60% to 70%, which means 30% to 40% or more of the price in cash, as our guide to mortgages for foreigners sets out. A euro loan against dollar income carries the exchange rate for the whole term, so size it to survive a move in the rate rather than to the bank's maximum. If the purchase is meant to qualify for Category 6.2, the €300,000 has to be foreign money and cannot be financed from a Cyprus mortgage.

US reporting on a Cyprus home: what the property triggers and what it does not

The IRS says foreign real estate is not a specified foreign financial asset for Form 8938, so an apartment held in your own name does not go on that form. An interest in a foreign company, partnership or trust that holds the property is reportable once the thresholds are met. The bank account you use for the purchase is a different matter.

ReportWho filesThreshold
FBAR (FinCEN Form 114)Anyone with foreign bank, securities or other financial accountsAggregate value above $10,000 at any time in the year; due 15 April, with an automatic extension to 15 October
Form 8938, single filer living in the USFilers with specified foreign financial assetsMore than $50,000 on the last day of the year or $75,000 at any time
Form 8938, joint filers living in the USSameMore than $100,000 on the last day of the year or $150,000 at any time
Form 8938, single filer living abroadSameMore than $200,000 on the last day of the year or $300,000 at any time
Form 8938, joint filers living abroadSameMore than $400,000 on the last day of the year or $600,000 at any time

A buyer who keeps €60,000 in a Cyprus account to meet instalments crosses the FBAR threshold on its own, because the $10,000 counts all foreign accounts together, and the lower Form 8938 thresholds for people living in the US come next. The IRS says failing to file can bring penalties, including $10,000 for a missing Form 8938. The move-to-Cyprus filing calendar is in moving to Cyprus from the USA.

Selling a Cyprus property: how the gain is taxed in both countries

Cyprus charges capital gains tax of 20% on the gain from selling Cypriot property, and it does so whether or not the owner lives in Cyprus. The gain is the sale price less the purchase price and costs, both adjusted for inflation, and since 1 January 2026 the total gain from all your sales is tax-free up to €30,000 (or up to €150,000 on a main residence you have occupied for at least five years), as our selling guide sets out.

The IRS taxes the same sale in dollars. A US citizen is taxed on a worldwide gain, the IRS tells taxpayers to translate foreign-currency amounts into dollars at the exchange rate on the date of each transaction (Publication 54), and so the euro rate at purchase and at sale both change the dollar gain. The IRS says most net long-term capital gain is taxed at no more than 15% for most individuals (0% below $48,350 of taxable income for a single filer and 20% above $533,400, on 2025 thresholds), and individuals with a modified adjusted gross income above $200,000 (single) or $250,000 (joint) may owe a further 3.8% net investment income tax. A foreign tax credit for the Cyprus tax then reduces the US bill. Whether the credit offsets every part of the US tax, including the 3.8%, is a question for a US-qualified adviser.

A worked example with illustrative rates. You buy a resale apartment for €300,000 when the euro is $1.10, so the cost is $330,000, and sell it years later for €360,000 when the euro is $1.20, a price of $432,000. In euros the gain is €60,000, a 20% rise. In dollars the gain is $102,000, because the euro also rose. Cyprus tax at 20% of €60,000 is €12,000, or $14,400 at $1.20, before inflation adjustment and any exemption, both of which would lower it. If the gain sits in the 15% US band, the US tax is 15% × $102,000 = $15,300; the Cyprus tax of $14,400 is credited, and about $900 is left to pay in the United States, plus any net investment income tax.

If you live in the property as your main home, the IRS excludes up to $250,000 of gain ($500,000 on a joint return) when you have owned it and used it as your main home for at least two of the five years before the sale (Publication 523). The tests turn on ownership and use, and a holiday home you visit does not meet them. We found no rule in the IRS text limiting the exclusion to US homes, but confirm it for your own case before relying on it.

Does buying give you the right to live in Cyprus?

No. Ownership does not give residence, and Cyprus is not in the Schengen area, so no Cyprus status gives Schengen travel rights. An American without a permit is limited to 90 days within any 180-day period. The route that follows a purchase is Category 6.2: a first-sale new-build of at least €300,000 plus VAT, income from abroad of at least €50,000 (plus €15,000 for a spouse and €10,000 per child), and a visit at least once every two years. The pink slip and Category F suit those who do not buy. The choice between them is in moving to Cyprus from the USA and the Category 6.2 guide.

Closing a Cyprus purchase from the United States without travelling

Almost every step can be done from home: reservation, due diligence, signing under a power of attorney, lodging the contract and the permit application. The power of attorney is executed before a notary and apostilled, which takes one to two weeks. In the United States the apostille on a state-notarised document is issued by the Secretary of State of the state concerned, and your lawyer will confirm the exact office. The power of attorney belongs with your own independent lawyer, never with anyone on the seller's side. What you should not delegate is the final inspection before the last payment; buying property in Cyprus remotely has the detail.

Buying property in Cyprus from the USA: questions Americans ask

Yes. A US citizen is a non-EU buyer and needs Council of Ministers permission under the Aliens Law, which the lawyer applies for after the contract is signed. There is no government fee, and the permit usually takes weeks to months.

In euros a €250,000 new-build at 19% VAT comes to about €300,975 with a 1% legal fee and Land Registry charges. At an illustrative $1.15 that is about $346,000, and a 5% move in the exchange rate changes it by about $17,000.

Not if you own it directly: the IRS says foreign real estate is not a specified foreign financial asset. An interest in a company, partnership or trust that holds it is reportable above the threshold.

Yes, if the combined foreign accounts exceeded $10,000 at any time in the year. It is due on 15 April with an automatic extension to 15 October.

Both countries. Cyprus charges 20% on the inflation-adjusted gain, with exemptions of €30,000 or up to €150,000 on a main residence. The IRS taxes the dollar gain and allows a foreign tax credit for the Cyprus tax.

Yes, from a short list of banks, at roughly 60% to 70% of the price for a non-EU non-resident. The €300,000 for Category 6.2 cannot be financed from a Cyprus mortgage.

Not by itself. Category 6.2 needs a first-sale new-build of at least €300,000 plus VAT and income from abroad of at least €50,000, and it is a separate application.
